These Terms of Use ("Terms") govern your access to and use of the mobile application operated by Wave AI LLC ("Company," "we," "us," or "our") and related services (collectively, the "Services"). Wave AI LLC is a limited liability company registered in the State of Wyoming, United States.

The application these Terms govern is DND AI (the "App"), published on the Apple App Store. They also apply to this website.

By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

DND AI is an AI-assisted tabletop role-playing app. It provides an AI dungeon master that narrates and runs solo or group role-playing sessions, generates adventures, scenarios, and battle maps, and answers rules questions drawn from the System Reference Document.

The App also allows users to upload images (such as selfies) and generate AI-transformed images and short videos (for example, fantasy-style characters, character cards, and cinematic scenes). All narration, imagery, and other output is generated automatically by artificial intelligence systems.

We may modify, suspend, or discontinue any part of the Services at any time without notice.

2. User Content

2.1 Your Content

"User Content" means any images or materials you upload to the App, together with the text you write during play — including character descriptions, prompts, and the instructions you give the AI dungeon master.

You represent and warrant that:

• You own or have all necessary rights to upload and use the content;
• Your content does not violate any law or infringe any third-party rights (including privacy, publicity, or intellectual property rights);
• You will not upload unlawful, abusive, exploitative, or harmful content.

2.2 License Grant

You grant Wave AI LLC a limited, non-exclusive, royalty-free license to process, transmit, and temporarily store your User Content solely for the purpose of providing the Services (i.e., generating and delivering AI outputs, and saving your gameplay content to your account so you can return to it).

We do not claim ownership of your User Content.

2.3 Third-Party AI Processing and Your Consent

To deliver AI-transformed images, your uploaded images (including any face data) are transmitted to the following third-party AI service providers:

• Fal.AI (fal.ai) — AI-based image generation and processing
• Google Cloud — Cloud infrastructure and AI processing services

By submitting an image for transformation (e.g., tapping "Generate"), you explicitly consent to your image being sent to these providers solely for the purpose of generating your requested output. These providers do not retain, sell, or use your images for any purpose other than fulfilling your transformation request. Please review the Privacy Policy for full details on what data is sent, to whom, and how it is protected.

3. AI-Generated Output

The narration, images, videos, and other material generated by the App ("Output") are created automatically based on your input.

You acknowledge and agree:

• Output may be inaccurate, unexpected, or incomplete;
• Output should not be relied upon for professional, legal, medical, or safety-critical purposes;
• Rules answers are generated by an AI system for convenience and are not an official interpretation of any published game rules;
• You are solely responsible for how you use or distribute the Output.

As between you and Wave AI LLC, you may use the Output for personal or commercial purposes, provided your use complies with applicable law.

4. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose;
• Upload content that is illegal, defamatory, hateful, abusive, or sexually exploitative;
• Upload images of others without proper authorization where required by law;
• Reverse engineer, copy, or exploit the App;
• Use bots, scrapers, or automated systems without permission;
• Interfere with or disrupt the Services.

We may suspend or terminate your access if you violate these Terms.

5. Payments and Subscriptions (If Applicable)

Certain features may require payment or subscription.

• Pricing is displayed in the App before purchase.
• Subscriptions may automatically renew unless canceled.
• You may manage or cancel subscriptions through your Apple ID account settings.

Refunds for purchases made through Apple are governed by Apple's policies. We cannot directly issue App Store refunds.

6. Intellectual Property

The App, including its software, branding, and design, is owned by Wave AI LLC and protected under U.S. intellectual property laws.

You may not reproduce, modify, distribute, or commercially exploit the App itself without our written consent.

7. Account Deletion

You may stop using the Services at any time. To have your account and the gameplay content associated with it permanently deleted, email admin@waveaillc.com with the subject line "Data deletion request". The process is described in Section 7 of our Privacy Policy.

8. Our Use of Social Media Platform APIs

Wave AI LLC operates social media accounts to market its own apps, and uses social platform APIs to review the performance of its own posts. That activity involves only accounts owned by Wave AI LLC and authorized by us through the relevant platform's OAuth flow; it does not involve your data as a user of the App. It is described in full under Our Use of Social Media Platform APIs in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, secure, or error-free operation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVE AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

• $100 USD, OR
• THE AMOUNT YOU PAID US IN THE LAST SIX (6) MONTHS.

11. Indemnification

You agree to defend, indemnify, and hold harmless Wave AI LLC from and against any claims, damages, liabilities, and expenses arising from:

• Your use of the Services;
• Your User Content;
• Your violation of these Terms;
• Your violation of any law or third-party rights.

12. Governing Law

These Terms shall be governed by and construed under the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
